Obama's HealthScare Plan - Now The Lawsuits

The Obama/Reid/Pelosi HealthScare Plan will be challenged by various groups related to probable violations of various clauses of the U.S. Constitution including the equal protection clause. The first potential lawsuit has surfaced. The Republican Attorney Generals of 13 states; Alabama, Colorado, Florida, Idaho, Michigan, North Dakota, Pennsylvania, South Carolina, South Dakota, Texas, Utah, Virginia and Washington have sent a letter to Democrat Socialist Speaker of the House Nancy Pelosi of San Francisco and Senate Majority Leader Harry Reid of Search Light, Nevada demanding that the "Cornhusker Kickback" be removed from the legislation.

To refresh memories this was the bribe paid to Democrat Socialist Senator Ben Nelson of Nebraska to buy his vote for Reid's version of HealthScare. Nelson insisted that Nebraska never have to shoulder any additional Medicaid expenses into perpetuity that will be required of all other states after some of their bribes expire i.e. the $300 million that went to Democrat Socialist Senator Mary Landrieu of Louisiana to buy her vote. Logically, the Attorney Generals of 13 states see these sleazy back room deals as contrary to the interests of all other states and their taxpayers that will have to foot the bill for Nebraska FOREVER; hence the reason for their demand and threat of lawsuit.

But this is just the beginning. Democrat Socialist Senator Bill Nelson of Florida extracted an exclusion of cuts to Medicare Advantage in Florida, which will allow Seniors in Florida to keep their Medicare HMO's, while Seniors in all other states will lose this beneficial program. The cost is estimated to be $3 Billion which is the jackpot of all sleazy deals to buy a vote for the HealthScare Plan. Obviously, the Nelson Brothers did pretty well, didn't they? No doubt, if this provision stays in the bill, we will see a class action lawsuit filed on behalf of the Seniors of 49 other states that will lose their HMO benefits under the Obama/Reid/Pelosi Socialist HealthScare Plan.

Finally, there is some question about the Constitutionality of forcing people to buy health insurance or pay a fine. Millions of young people in particular choose not buy health insurance either because they can't afford it, or perhaps because they prefer to make their BMW lease payments rather than buy health insurance. In either case, there could be another class action lawsuit to prevent enforcement of this provision. Besides, under Obama's HealthScare Plan since the uninsured only have to pay a $750 fine if they choose not to buy health insurance and cannot be denied insurance if they become very ill, why buy the insurance anyway. Many people will just wait to get sick and then buy health insurance rather than pay the more expensive premiums we will experience under Obama's HealthScare Plan.

President Obama and the Democrat Socialists that control Congress are enacting a HealthScare Plan that is a monstrosity by any standard. HealthScare, which is now opposed by 58% of Americans, will result in higher premiums for all because of all the mandates on insurance companies, rationing, cuts in benefits, death panels, higher taxes and generally worse health care than what most Americans have today.

Clearly, we have to take back our country and repeal the pending bill that will be passed shortly and be signed by our Socialist President. The elections in 2010 and 2012 will be a turning point provided we elect Conservatives committed to fiscal sanity and national security. We can do it. We have to do it.
